The Americans with Disabilities Act"No qualified individual with a disability shall, on the basis of a disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity or be subjected to discrimination by any public entity." (28 CFR Part 35-130) The Americans with Disabilities Act Title II:Title II of the Americans with Disabilities Act of 1990 prohibits state and local governments from discriminating against qualified individuals with disabilities and is to ensure that pedestrians with disabilities have opportunity to use the transportation system in an accessible and safe manner. In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990, the Oklahoma Department of Transportation (ODOT) will not and does not discriminate against qualified individuals with disabilities on the basis of disability in ODOT services, programs, activities, or employment practices. Complaint Process - Complaint FormThe ADA Complaint Procedure is established to meet the requirements of the Americans with Disabilities Act. It may be used by employees and non-employees who wish to file a complaint alleging discrimination on the basis of disability in programs or benefits offered by ODOT. In the event an individual believes that the Department has failed to comply with ADA by not providing equivalent access to a Department service, program, or activity, that individual or group of individuals may file a complaint with the Department. The process for filing an ADA Title II Complaint will be as follows:
